High Court Judge, Justice Salesi Temo will sum up the rape trial of an 87-year-old man tomorrow who is alleged to have raped an 11-year-old girl in Nakasi.
The 87‑year‑old man is charged with two counts of rape and a count of sexual assault.
The alleged incident took place between April and May 2016 in Nakasi when the 11-year-old girl and her mother were tenants at the man's house.
Defence lawyer, Samanunu Vaniqi while delivering her closing submission said that the girl is lying and that the girl's aunt is the villain in this case.
She further questioned saying would an 85-year-old man be able to have sex in five seconds as this what the girl is alleging.
She adds that the whole rape drama arose from an eviction notice given by the elderly man after items were found in the 11-year-old girl's flat which was considered by the landlord as theft.
Meanwhile, state Lawyer Kimberley Semisi said that this is a rape case which was committed by the elderly man and it has nothing to do with the eviction notice.
She further stated that the doctor who was called as a state witness is a child specialist and she had told the court that there were signs that the girl had been raped.
The summing up will take place at 2.15pm tomorrow.
