The Suva High Court has once again deferred its ruling in the matter where former Solicitor General Sharvada Sharma had applied for a judicial review against his termination.
The ruling has been deferred 7 times since last year.
The ruling was expected to be delivered on Tuesday, but it was vacated and deferred to yesterday, however it has once again vacated and the ruling is now expected to be delivered on Friday.
The matter was deferred three times in May last year, and it was then stated that it will be delivered on notice.
The ruling was to be delivered on 10th November last year but was deferred to the 15th of November as it was not ready however the matter was not called on the 15th as the courts were closed due to bad weather conditions.
The Civil High Court registry had earlier this month confirmed that the ruling would be delivered on Tuesday.
No reason has been given as to why the ruling dates have been vacated each time.
Sharma had taken legal action against the President of Fiji, the Judicial Services Commission and the Attorney General of Fiji in relation to the termination of his employment on 10th of November, 2021 by former President Jioji Konrote.
Sharma’s lawyer Jon Apted had earlier argued in court that Sharma’s dismissal was in breach of the relevant provisions of the constitution governing process.
He had said that Sharma was not accorded common law rights to natural justice.
Sharma was suspended without pay and later terminated as Solicitor General.
He was suspended by the President of Fiji on 20th September 2021 on the advice of the Judicial Services Commission.
Under sections 112 and 116 of the Constitution, the Solicitor General can only be removed from office after a proper inquiry by an independent tribunal.
In Sharma’s case, no tribunal inquiry was held.
