SODELPA MP Ratu Suliano Matanitobua has been found guilty of a count each of Giving False Information to a Public Servant and Obtaining Financial Advantage.
He falsely stated his place of residence as Namosi Village, Namosi and obtained $38,378.22 as parliamentary allowances.
While delivering the judgment via Skype, High Court Judge, Justice Thushara Kumarage says there is not an iota of evidence to prove Ratu Suliano lived in Namosi Village.
He says Ratu Suliano was also not residing in Veivatuloa Village however, FICAC was unable to establish comprehensively beyond reasonable doubt that Ratu Suliano lived in Statham Street, Suva.
However, the Judge says there is no burden on FICAC to prove Ratu Suliano’s actual place of residence.
Justice Kumarage also says a paramount chief needs to be treated the same way as any other person.
The matter has been adjourned to the 29th of this month for mention.
