The lawyer of suspended Naitasiri under-19 rugby player, Keresi Maya who allegedly punched a referee in August this year during a match will be filing a stay proceedings application in the Suva High Court.
His lawyer, Sevuloni Valenitabua told the court this morning that Maya has been penalised by the Fiji Rugby Union where he has been suspended from playing rugby union for 6 years.
He said the continuation of the proceedings against Maya would lead to double jeopardy.
Double jeopardy occurs when a person is punished twice for the same crime.
Maya is charged with one count of assault causing actual bodily harm.
Valenitabua will be filing his submissions by the 23rd of November while DPP lawyer Yogesh Prasad will be filing a response within 21 days from then.
The case has been adjourned to the 20th of January, 2021.
