The defence lawyer in the rape trial of the former proposed candidate of the National Federation Party has filed a no case to answer application in the Suva High Court.
While filing the application, Devanesh Sharma says the evidence in the case has not been pinpointed to each counts.
Sharma says there has been suppression of evidence as the broken bed, position of bed , the baby oil and the clothes that were allegedly torn have not been tendered.
He says he was told that the photographs that were taken at the scene have been corrupted.
Judge, Justice Thushara Rajasinghe will deliver his ruling tomorrow morning.
Meanwhile, two rape charges and 2 sexual assault charges against the man were dropped this morning.
He now faces five counts of rape and 2 counts of sexual assault.
The 66‑year‑old man is alleged to have raped and sexually assaulted his 54‑year‑old sister in law in Nasinu in June last year.
