The Online Safety Commission is assessing and investigating a complaint regarding Kishore Kumar’s posts about National Federation Party MP, Lenora Qereqeretabua.
Legend FM News has received information that the complaint was filed a few days ago.
The Online Safety Commission does not have the mandate to prosecute a matter however they may apply to the court on behalf of the complainant for a court order which may include an order to publish an apology, not contact the complainant or not send any other related content.
To date, the Commission has not needed to excerise this application because reports are usually resolved in the alternative methods.
This year, the Commission received 322 complaints with 12% deemed online bullying.
Of the online bullying matters, 85% have been resolved by way of reconciliation between the individuals, serving a notice of removal of the electronic communication to the alleged individual producing the content or by escalating removal of the content from the social media platform itself.
The remaining 15% are pending assessment and investigation.
However, the majority of reports lodged this year and last year continue to be defamatory comments and/or posts that have been resolved by way of reconciliation between the individuals in the matter or providing the complainant with actionable advise such as blocking, deleting or removing the content and/or to their right to seek a lawyers' assistance with a defamation claim.
9% of complaints received this year have been classified as image based abuse matters meaning these were complaints regarding explicit intimate content that have been sent, published, posted, or shared without consent of the individuals in the content.
All of these matters have been referred to Fiji Police for further investigation and possible prosecution.
