Lautoka lawyer, Aman Ravindra Singh has filed an application in the Lautoka High Court for a leave for a judicial review against the 'no jab, no job' policy.
The matter was called before Chief Justice Kamal Kumar this morning.
Singh has filed the application on behalf of Vasiti Toga who is a former senior investigator of the Fiji Revenue and Customs Service.
He has filed the case on the basis that the policy was against Section 11(3) of the Fijian Constitution.
Section 11(3) of the Constitution states that every person has the right to freedom from scientific or medical treatment or procedures without an order of the court or without his or her informed consent, or if he or she is incapable of giving informed consent, without the informed consent of a lawful guardian.
The respondents in the matter are the Minister for Employment, Permanent Secretary for Employment and the Office of the Attorney General.
A representative from the Office of the Attorney General told the court that they have not been served any documents and appeared in court to only observe.
Chief Justice Kumar has directed Singh to serve the documents to the respondents by tomorrow where the respondents are to file their response by 16th November.
Singh must file an affidavit of reply by 30th November.
The matter has been adjourned to the 2nd of December.
Meanwhile, the Chief Justice had struck out an earlier case by Singh on behalf of Toga and 4 others due to non appearance.
