The Fijian Teachers Association has made an application for constitutional redress in the Suva High Court after more than 200 teachers lost their jobs for not getting the COVID-19 vaccine.
The matter was called before Chief Justice Kamal Kumar today and has been adjourned to 20th October.
Under the OHS Regulations announced by the Prime Minister in July this year, workers cannot enter the workplace if they have not received the first dose of the vaccine by 1st August.
The FTA says that the regulations are inconsistent with the Employment Relations Act.
They say this is because there is no evidence that unvaccinated employers and workers make the workplace unsafe and vice-versa.
The FTA also says there is no evidence that all other COVID-19 protocols made conditional by the Ministry of Trade and Commerce to workplaces reopening have failed necessitating mandatory.
They add the State made the regulation stipulations of employment instead of stipulations of public health.
