Two men charged with one count of rape each have been acquitted by the Lautoka High Court.
High Court Judge Justice, Sunil Sharma overturned the opinion of the three assessors who found the two accused guilty of rape.
It was alleged that the two men raped a woman between the 24th and 25th of April, 2013 in Nadi.
The court was informed that the woman knew one of the men.
Justice Sharma says he does not accept the evidence of the complainant as truthful and reliable.
While giving his judgement, Sharma says there was inconsistency between the complainant’s evidence in court and her police statement when facts were fresh in her mind.
Justice Sharma says the inconsistent explanation given by the complainant is unacceptable.
