Serving prisoner Ben Padarath’s appeal has been dismissed by the Suva High Court.
Padarath made an application for the High Court to set aside the sentence of 25 months imprisonment imposed on him with a non-parole period of 16 months.
He was charged for providing false information to a public servant in 2011.
In his grounds of appeal, Padarath had said that the sentence was harsh and excessive.
He also said that the court failed to apply proper and appropriate sentencing principles as well as appropriate deductions for mitigation as he had pleaded guilty and saved the court’s time.
Justice Achala Wengappuli said the sentence imposed by the Suva Magistrates Court cannot be considered as harsh and excessive in view of the attendant circumstances.
The Judge said the sentence imposed by the Magistrates Court is legal and appropriate.
