The Director of Public Prosecutions, Christopher Pryde, says the State will appeal the decision of the High Court to acquit Australian Yvette Nikolic on charges of importing illicit drugs into Fiji and possessing arms and ammunition without a licence.
The High Court acquitted Yvette of all charges following a finding of no case to answer on the 18th of last month.
Her husband John Nikolic, was convicted on the same
charges and is currently serving a sentence of 23 years imprisonment.
Pryde says the judge made an error of law in finding there was no case for Yvette Nikolic to answer.
The Notice of Appeal against the decision to acquit was filed in the Court of Appeal this afternoon.
