There is confirmation today that a 33 year old man who raped his 22 year old sister is serving his prison sentence only in the weekends as ruled by Nasinu Magistrate, Sumudu Premachandra.
In his ruling, Magistrate Premachandra said the man is to serve his 8 year sentence every weekend.
He said this means that the man goes to prison at 7pm every Friday and is to be released from prison at 7pm every Sunday.
The sentence was partially suspended on the rest of the weekdays.
While sentencing the man, the magistrate said the aggravating factors in this case are that the complainant is the man's sister, he betrayed the trust of brother and sister and the victim was severely assaulted.
It was highlighted that the man who was an ex Special Police Inspector was overjoyed by his Sukuna Bowl win in 2007 that he started drinking from Friday and continuing for 24 hours until the incident happened.
Magistrate Premachandra said it seems that the act was done by his alcohol, if he was in normal sense he would not have done this act.
The magistrate said it is seen that the act was done to get rid of the man's sister's homosexual behaviour and this was a random act, not premeditated.
In the ruling, the magistrate said when contemplating, it is a sad and unfortunate incident but the offence was done by the accused.
Magistrate Premachandra said the man was foolish and no proper judgment could be taken at the time due to his irregular mind.
He said normally, incestuous rapes are done by perpetrators for a long period of time on victims and many times but in this occasion, it was a single act of rape.
The man raped his sister while questioning her about her alleged homosexual behaviour.
