Fiji Labour Party lawyer, Anand Singh said in Suva High court today that if his client Steven Singh filed his nomination properly and paid his registration fee then there is no reason that he should be excluded from taking part in the general elections.
Singh is seeking a constitutional redress after he was disqualified from contesting the elections due to a conviction.
However according to Anand Singh that conviction has been set aside by the court.
During the preliminary objections hearing in court today Singh argued before Judge Justice Kamal Kumar that his client has suffered at the hands of the official.
Singh stressed that Singh is qualified to be a candidate and it is in evidence.
He also said that elections have not commenced yet.
However, Solicitor General Sharvada Sharma informed Justice Kumar that 750,000 ballot papers and the candidate list have been printed at considerable figures.
Sharma also told the court that postal ballots are being issued as of today and people who may be leaving for abroad tomorrow may be voting now.
Justice Kumar has asked both parties to file in their submissions and respond by Wednesday.
The case will be called again next Thursday.
