Ratu Isoa Tikoca’s case was called in the Suva High Court today where he has filed an application for leave to apply for judicial review challenging the decision of Parliament to suspend him for the rest of the term of parliament until 2018.
Solicitor General Sharvada Sharma who is representing the Speaker of Parliament had objected to the application and also filed an application for a stay to await the decision of the Ratu Naiqama Lalabalavu case as the same arguments have been made in that case.
However, High Court Judge, Justice Lyone Seneviratne told Sharma that Ratu Naiqama’s case is a separate case and they will not await the decision of that case.
As a consequence, Sharma has told the court that they will now file a strike out application on the grounds that the court does not have jurisdiction to question the internal proceedings of parliament.
Sharvada Sharma will file the strike out application in the next 14 days.
The matter has been adjourned to the 19th of next month.
