Suspended parliamentarian, Ratu Naiqama Lalabalavu’s lawyer, Julian Moti said they may ask the court to get the recording to hear the comments made by Ratu Naiqama Lalabalavu about the Speaker.
Moti told the court today that he is left with no other option but to serve the subpoena after they were not given the recording.
Moti said they have written to the Solicitor General’s Office requesting for the release of the recording.
He said they understand that the instructions were to refuse the request.
Solicitor General, Sharvada Sharma told the court that the recording was heard by the Parliamentary Privileges Committee and the report was tabled in parliament.
Sharma said the recording is not relevant and the Privileges Committee’s report and the Hansard is before the court which is sufficient evidence.
He also said the recording is not of a rugby game but swear words made towards the Speaker.
Sharma told the court that Ratu Naiqama also apologised in Parliament, apologised to the Speaker and also made an apology to the Speaker and her family during a recent public meeting in relation to what he had said.
Chief Justice Anthony Gates said the written submissions should be filed before the 27th of October and responses to be filed before 10th November.
A hearing date has been set for the 15th of December.
