Rabindar has a case to answer - Justice Temo

High Court Judge, Justice Salesi Temo will sum up Rabindar Singh's case this Friday.

Justice Temo ruled earlier today that Singh has a case to answer in relation to an accident where a 46‑year‑old woman and a 3-year-old girl died at the Suva bus stand in 2014.

Singh is charged with manslaughter.

Singh who was a checker with Dee Cee’s Bus Services Limited in 2014 is alleged to have driven the company’s bus at Suva bus stand which hit a Nasese bus from the back.

The mother and her daughter were crushed between two buses.

Defense lawyer, Priya Lal made a submission of no case to answer saying her client was not aware that the brake of the bus was not working.

Lal told court that Rabindar Singh only knew that the clutch was not working.

She told the court that the job description of her client was to keep the base clear at the Suva bus stand and he was just trying to do that.

Lal also told the court that Singh was not reckless.

DPP lawyer Timoci Qalinauci then said that there is a case to answer.

He told the court the accused knew there were mechanical defects in the bus.

Qalinauci then said that prosecution has proven the case and the elements of the manslaughter charge.

The two counsels will make their closing submissions this afternoon.
