High Court Judge Justice Vinsent Perera has acquitted a couple who were facing charges of manslaughter.
While giving his judgement, he said that the first prosecution witness Taina Maresela who is a staff nurse at the Samabula Health Centre was not credible and reliable.
Referring to the evidence by the first prosecution witness, Justice Perera said it is easy to be wise after an event has occurred.
He said the prosecution failed to prove beyond reasonable doubt that the parents of the one year and ten months child breached their duties as parents.
Justice Perera said he was also not convinced that the actions of the second accused amounted to criminal negligence.
The Judge said that he believed the evidence of the mother of the child when she said she had to take the child back to Vunidawa because he was hungry.
Justice Perera said it was a reasonable decision as they had been waiting at the Samabula Health Centre for two and half hours.
The three assessors had earlier found the couple not guilty.
It was alleged that 34-year-old Petero Taitusi and 29-year-old Loata Vitalina of Sawanikula in Naitasiri failed to ensure the safety of their 1‑year‑10-month old child.
The 1‑year‑10-month old baby died at 7am on the 28th of February 2013 at his home in Sawanikula, Vunidawa.
