High Court Judge Justice Riyaz Hamza has ruled that the 33-year-old man who is charged with raping his defacto partner’s 4-year-old adopted daughter in Navua, has a case to answer.
The man is charged with two counts of rape.
The alleged incident occurred in March this year.
Justice Hamza has ruled that there is a case to answer for both counts of rape.
He said that he is satisfied that there is some evidence touching on the elements of rape.
Justice Hamza then dismissed the no case to answer application filed by defence lawyer Aseri Vakaloloma.
Vakaloloma has confirmed that he will present 7 defence witnesses.
This includes the accused, the examining doctor, a psychologist, two police officers, a social welfare officer and the adopting mother.
The accused is currently taking the stand.
