A man of Davuilevu Housing charged with the rape of a mother of two has been acquitted by the Suva High Court.
Judge, Justice Paul Madigan concurred with the three assessors and found the accused not guilty.
The alleged offence happened on the 30th of August 2012.
Justice Paul Madigan said the complainant=s evidence was inconsistent with other statements she had made about the alleged offence.
He said the evidence given by the accused was directly in contradiction of the complainant=s evidence and the sole issue of the consent then became a question of credibility.
The court heard that the accused was inside the shop that evening when he met the complainant who came to wait for her husband.
The woman had claimed that she was raped near the shop.
The woman and the man had a relationship in 2011.
