Judge Justice Riyaz Hamza has stated that a 36-year-old man charged with rape is not in a proper state of mind.
Justice Hamza informed both the defence and state lawyers that the St Giles Hospital’s report clearly states that Paula Seru is not physically fit to stand trial.
It is alleged that Seru had raped a 3 year old girl on 22nd June in 2015.
Justice Hamza says though Seru has pleaded guilty to the charge, he can not accept his guilty plea.
State lawyer Lavenia Bogitini will be confirming the states position in relations to the psychiatric report from St Giles Hospital on the 8th of next month.
