High Court Judge, Justice Daniel Goundar has set aside the 11 months sentence of a man who has charged with defilement and has now sentenced him to 3 and a half years imprisonment.
The incident happened between November 2015 to March 2016.
Justice Goundar says after the man was sentenced, the girl’s grandfather wrote to the Judicial Department where the Chief Justice then handed the matter to the High Court.
While delivering the judgement, Justice Goundar says the victim was 13 years at the time of the incident and she became pregnant and she gave birth.
Justice Goundar says the man used to work for the grandfather of the girl and he gave the girl a mobile phone.
The matter came to light after the grandmother found the mobile phone.
He says the sentence should not have been for rehabilitation but for deterrence.
Justice Goundar says that defilement is prevalent in our society.
A non-parole period of two years has been set.
