A man has been acquitted of two counts of rape by the Suva High Court.
Justice Thushara Rajasinghe acquitted the man after he found the complainant’s evidence unreliable during the trial.
The court was told that it was alleged that on 13th July 2014, the man raped a woman but Justice Rajasinghe said that the complainant was evasive and did not answer the questions directly.
The complainant in her evidence told the court that she does not know how the man entered the house but in her cross examination she said she saw the man put his hand through the window and opened the door from inside.
The complainant also agreed with the man that they did not have sexual intercourse the second time.
Justice Rajasinghe said that there is reasonable doubt about truthfulness, credibility and probability of the evidence given by the victim therefore it is not safe to accept her evidence.
