High Court Judge, Justice Lyone Seneviratne will rule on the application to strike out the National Federation Party’s case against the Registrar of Political Parties Mohammed Saneem on the 23rd of next month.
Lawyer from the Attorney General’s Office, Seema Chand who is representing the Registrar of Political Parties, has filed the strike out application.
Chand said the Registrar had the discretion to suspend NFP as the issue came about from the audit.
The NFP was suspended after the Registrar of Political Parties, Mohammed Saneem said the NFP’s accounts were not audited by an accountant certified by the Fiji Institute of Accountants.
NFP lawyer Jon Apted says the NFP had the right to lawful and fair decisions however the decisions of the Registrar were not proportionate and fair.
Apted says it was not necessary to suspend the party.
He says the NFP parliamentarians rights to participate in parliament were breached and the Registrar does not appear to be aware of his duties.
Apted also said in his submission that the Registrar should have respected the rights of NFP parliamentarians and people should be allowed to represent their people as 27,000 voters were affected by this decision.
He says the NFP parliamentarians also received no pay during the suspension.
Apted also says that it is a hopeless application to strike out the case.
