High Court Judge, Justice Daniel Goundar has told the prosecution if they fail to file information in the next 21 days against a pastor and a senior church member who are charged with rape, then he will dismiss the case.
He made these comments after the prosecution informed court that they have filed disclosures but seek more time to file the information.
Waisake Tulavu who is the pastor of the Agape Healing Church Ministry is charged with four counts of rape while senior member of the church Sakiusa Nakutoro is charged with one count of rape.
Justice Goundar asked prosecution why is there a delay to which the prosecution said that they went to Naitasiri to meet the complainants and they managed to meet only one complainant.
They are working on meeting the other complainants.
State also informed court that they are yet to confirm their position in regards to Nakutoro.
Nakutoro had earlier told the court that he intends to become a state witness.
Nakutoro had told the Judge that he didn't commit any crime however witnessed it.
The victims in these cases are aged 22, 29 and 32 years and were members of the church.
The first alleged incident occurred on the 11th of May last year, the second incident occurred between the 1st of May to the 31st of May last year, while the third incident occurred on the 15th of September last year.
The case has been adjourned till 29th April.
