High Court Judge Justice Vinsent Perera will sum up the rape trial of two former Corrections Officers this afternoon before the assessors retire behind closed doors to deliberate on their opinion.
The three counsels in the trial made their closing submissions this morning.
While making the closing submission of the prosecution, DPP Lawyer Sujata Lodhia said the accused persons saw a drunk woman and took advantage of her.
Lodhia told the assessors that from the very moment the alleged rape victim blacked out, she could not recall anything.
She said the alleged rape victim was honest enough to say that she blacked out.
Lodhia said the alleged rape victim could clearly remember the incident because it was something that happened to her by force.
The lawyer for the first accused Barbara Malimali told the assessors that there is nothing abnormal with men and women having sex when they are drunk.
Malimali also said that no evidence was produced by the prosecution to prove that the alleged rape victim blacked out.
She said there was no blood alcohol level test done to prove how much alcohol the complainant would have consumed to black out. Malimali said there is insufficient evidence to prove that her client is guilty.
The lawyer for the second accused, Namrata Mishra told the assessors that her client, Nasoni Kaburau is being punished for being the good samaritan.
She said her client only helped the complainant put on her pants after the alleged incident.
Mishra said the second accused refused to have sex with the complainant.
