The High Court has decided to review the sentence delivered for 85-year-old William Apted for one count of dangerous driving occasioning death and two counts of dangerous driving occasioning grievous harm on the 8th of this month by the Magistrates Court.
The Office of the DPP has said pursuant to Section 260 of the Criminal Procedure Decree, the High Court may “call for and examine the record of any criminal proceedings before any Magistrates Court for the purpose of satisfying itself as to the correctness, legality, propriety of any finding, sentence, order recorded or passed and the regularity of any proceedings of any Magistrates Court”.
The matter has been adjourned to the 16th of July for the State to provide an amended Summary of Facts.
The matter will then be set down to hear submissions on whether the sentence should be reviewed or remain the same.
William Apted has been disqualified from driving for two years and fined $6,000 by Chief Magistrate Usaia Ratuvili.
Apted was charged after the death of a 4-year-old girl in a road accident in Varani Street, Raiwaqa, last year.
He had pleaded guilty to the charges.
