FICAC has submitted the grounds of their submission in their appeal case against Former Education Minister, Doctor Mahendra Reddy.
While making his oral submission in the hearing today, FICAC lawyer Rashmi Aslam said the Magistrate in his judgement failed to consider the political rights of Waisea Lelobo.
He said the element of the offence is a constitutional right and it is mandatory for the Magistrate to refer to the Constitution.
Aslam said there is not a single reference to the constitution if you read the judgement.
He also said water is a basic right and the Magistrate failed to consider that.
Aslam said the intention of Doctor Reddy was clear when he said "the reason we are giving you the water is because you will not criticise".
Reddy was found not guilty of a count each of bribery and undue influence by Chief Magistrate Usaia Ratuvili.
The case is continuing.
