The case regarding a Nasinu doctor Shanjivan Padarath who has taken the Fiji Broadcasting Corporation and its reporter Savaira Tabua to court for allegedly defaming him, was called in the High Court today.
FBC filed the statement of defence submission and Padarath has been given 21 days to respond to the submission.
The matter will be called on the 26th of next month for summons for direction.
Doctor Padarath is claiming $2 million compensation saying that more than 2 million viewers had access to the FBC website and facebook.
He claims that he never gave any permission or instructions to Fiji Broadcasting Corporation and its reporter to use his photograph in a report they published that said that he is a fake doctor.
This report was on the FBC website and was shared on the Mirchi FM facebook.
The doctor also claims that the photograph used caused defamation.
He said the article was understood to mean that he is not a qualified doctor and that he carries fake qualifications.
He says that he is a qualified doctor and is employed by the Fijian Government.
The doctor said that after being advised by the viewers about the article on 9th September last year, he wrote to the Medical and Dental Council about the article and he was advised to lodge a complaint with MIDA and police.
