Director of Public Prosecutions Christopher Pryde today filed an appeal to the Suva High Court after the acquittal of Colombian national Aiden Alec Hurtado.
The appeal was made in the presence of Justice Daniel Goundar, Justice David Alfred and Justice William Callanchini.
The appeal hearing will take place on the 21st of this month.
Meanwhile, Hurtdao’s lawyer Samanunu Vaniqi said her client’s non-departure order should be removed and he should be allowed to return to his country.
The DPP objected to this.
The court said the DPP is given time to prepare his submission until 5th of January 2016 while Hurtado’s lawyer is given time to prepare the submission to remove his stop departure order until 15th of January 2016.
The hearing on Hurtado’s non stop departure will be heard on the 20th of January 2016.
Aidan Alec Hurtado was charged with the unlawful importation of 20.5kg of cocaine into Fiji in 2014.
