The 14-year-old who was found guilty of the manslaughter of a former Fiji citizen and Auckland dairy shop owner Arun Kumar has been sentenced to six years imprisonment by the High Court in Auckland.
According to Radio NZ, the Judge told the teenager that his severe brain injury saved him from being convicted of murder.
He will serve the majority of the sentence in a youth justice facility and it will be up to authorities whether he is transferred to a regular prison when he turns 17.
A 13-year-old who was also with the 14-year-old during the incident was cleared of a charge of manslaughter last month.
During the trial, the court heard that the two went to Rob Henderson’s Railside Dairy with a knife and a metal pole in June last year.
During a fight, Kumar produced a large metal pole in defence when he was stabbed by the 14-year-old on his neck and died at the scene.
At a jury trial last month, the boy was found not guilty of murder but guilty of manslaughter after taking part in the fatal robbery.
Kumar’s family did not attend today’s sentencing.
They said they watched how the offenders became victims during the trial and Kumar became insignificant.
The teenager has to serve a minimum non-parole period of three years and three months.
