Bau chief, Ratu Epenisa Cakobau has filed a fresh application for a Domestic Violence Restraining Order against the Crime Officer of Nausori Police Station, Viliame Maivusa and soldier, Marika Uluinakasaleka.
He made this application in the Suva Magistrates Court before Magistrate Jioji Boseiwaqa.
In his application, Cakobau has said that on 8th June this year, Viliame Maivusa stormed into his room, broke his door, armed with guns and without a search warrant and kidnapped him at gun point.
Cakobau says Maivusa harassed, threatened, assaulted and behaved in a very abusive way.
Ratu Epenisa Cakobau in his application says Maivusa was cruel, inhumane and intimidated his family.
The Bau chief says he has gone through trauma as he was treated like a criminal.
Cakobau goes on to say that he has been told Maivusa might return at the end of next month and he does not see any remorse in him.
Cakobau has informed the court that Maivusa and Uluinakasaleka are part of the kinship.
In his response, Maivusa has stated he was acting in his official capacity of a police officer on the instructions of the Commissioner of Police and Cakobau was arrested.
Maivusa says he with other police officers had carried out their duties within the ambits of the law and had denied that any violence was used on Cakobau or his relatives or they were threatened.
Maivusa says the application for DVRO has to be made against any person who is or was in a Domestic or Family Relationship as provided for in the Domestic Violence Act.
On the other hand, Marika Uluinakasaleka has told the court he is from Kadavu and has maternal links to Kadavu and is not related in any way to Cakobau.
Uluinakasaleka has also denied the allegation that he was at Cakobau’s residence on 8th June and at no time he kidnapped Cakobau from his residence.
Magistrate Boseiwaqa has adjourned the matter to the 10th of next month.
