A mother charged with the rape of her three year old daughter is now a free woman after her case was discharged by Justice Daniel Goundar in the Suva High Court.
This is after the Office of the Director of Public Prosecutions filed to discontinue the case due to insufficient evidence.
It was heard in court that the daughter is now under the care of the Social Welfare Department after a Permanent Care Order was obtained on 12th February this year.
The court heard the girl now stays at Saint Christopher’s Home and is being visited by the father and sister.
The Permanent Care Order means the girl would have to stay at Saint Christopher’s Home until she is 18 years old.
After discharging the case, Justice Goundar told the woman that she would have to go to the Family Court if she wants to see her daughter.
According to information that was initially filed by Police in the case, the alleged incident happened between September 2018 to January 2019 in Samabula.
The woman herself took the child to the doctor in January this year after the child complained of stomach ache.
The case was then referred to the Social Welfare Department who reported the case to Police.
