The Chairman of Fiji’s Constitution Commission, Professor Yash Ghai had breached the Constitutional Process Decree by trying to reprint and distribute the draft constitution.
This is according to RFMF Land Forces Commander Colonel Mosese Tikoitoga who said Professor Ghai abused his appointment in this breaching process.
Tikoitoga said Professor Ghai’s role was not the consultation process but was to receive all the information and write the draft whereby the consultation would be done by the Constituent Assembly, which will later be assembled to debate on and inform the public.
He added it was not in his detailed task to do yet he went ahead and did it.
Fijivillage raised the issue with Colonel Tikoitoga, on whether Ghai’s actions were one of transparency.
Fijivillage asked whether he foresaw the Constitutional process being affected as a result of the draft constitution now being leaked.
According to the Fiji Constitutional Process Decree 2012, the Constituent Assembly is to hold its first sitting next week.
